Return and Refund Policy
Mark Funkhouser Photography has a Return and Refund Policy that does not allow for returns, refunds or exchanges on any items purchased, whether purchased through the online store, phone, email, in-person or any other kind of order. All sales are final. Although we do not admit to having any responsibility for items with a manufacturing defect or items damaged during shipping, for items with a manufacturing defect or items damaged during shipping, you may contact Mark Funkhouser Photography via the email specified in your order confirmation or the Mark Funkhouser Photography website as soon as possible after you receive the defective or damaged item. Mark Funkhouser Photography will attempt to work with the lab / manufacturer / shipper of the item to facilitate a replacement product utilizing the lab / manufacturer / shipper’s policies that apply to the circumstances. Lab / manufacturer / shippers have polices in place with time limits for making a claim of a damaged or defective item. If Mark Funkhouser Photography is unable to meet a time limit specified by the lab / manufacturer / shipper’s policies, Mark Funkhouser Photography will have no responsibility for either facilitating or providing a replacement product.
If you execute a written contract with Mark Funkhouser Photography for products and / or services, the terms of the contract, when in conflict with this Return and Refund Policy, will apply.

Adjustments and Alterations. Mark Funkhouser Photography reserves the right to make minor adjustments and / or alterations to items you order to best fulfill your order. For instance, Mark Funkhouser Photography may need to crop, resize or otherwise make alterations to an image for it to print properly on the medium you selected. Mark Funkhouser Photography will make adjustments and alterations at its sole discretion.

Appearance of Products. The physical product may not appear exactly as it did on your computer or other electronic device. Electronic devices vary in the way they show digital images and the physical product may have slightly different colors or other physical characteristics compared to what you saw on your electronic device. These variances are normal.

Sales Tax. Mark Funkhouser Photography collects combined Ohio and Franklin County sales tax on online sales orders for customers residing in Ohio. If you reside outside Ohio and make an online purchase, we do not collect sales tax. You, however, may be responsible for paying a sales, use or other tax to your own state for your purchase. You are solely responsible for identifying and paying any such due tax or taxes.

Standard License and Terms of Use for Digital Downloads

Print Release
The bearer of this notice has purchased digital image files from Mark Funkhouser Photography (MFP). Bearer is hereby granted permission by MFP to reproduce the images and make an unlimited number of prints, for personal use only. This permission applies worldwide. Bearer agrees that he/she may not use any MFP images for commercial or editorial purposes, or enter any MFP images into competition without the express written permission of MFP. MFP retains the copyright to all images, per USC Title 17 (US Copyright Law).
Copyright and Licensing Notice
The images that are being provided to you are licensed to you for any reason personal, including but not limited to: printing, copying, emailing, and web publishing. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature. MFP may revoke this license at any time and for any reason. MFP retains all copyrights to the images and derivative works thereof.
Additional Terms of Use
The images provided are subject to these additional terms of use:​

No unlawful use. The image(s) may not be used for any unlawful manner, such as pornography or defamation.

No Standalone File Use. The image(s) may not be used in any way that allows a standalone file or content file to be downloaded, extracted or redistributed by others.

No Use in Trademark or Logo. The image(s) may not be used in any trademark, design, logo or other mark.

No Products for Resale. The image(s) may not be used in any goods or products where the images are the primary value.

No Alterations. No alterations, including but not limited to, additions, subtractions, or adaptations in respect of the Photos, alone or with any other material, except that cropping and alterations of contrast, brightness, and color balance, consistent with reproduction needs need may be made. Any other alterations require the prior written permission of the Photographer.

No Sublicenses. Client will not sublicense the Photos without the prior written permission of Photographer.
